The Small Claims Process Explained

Someone (an individual or corporation) owes you money.

Every state has established a small claims court to resolve legal disputes involving an amount of money that is generally less than $10,000.00, without need to hire legal representation. The maximum limit also depends on how many small claims disputes have been filed by an individual in a 12 month period and if the Plaintiff is a company as opposed to a person. The parties cannot be represented by an attorney.

If you are the Plaintiff and you win your case, the Defendant can appeal by filing a “trial De Novo”, within 30 days of the judges’ decision. If the Defendant fails to file an appeal, the judgment becomes final and you can proceed with collecting your judgment. If the Defendant files for an appeal, the case will be schedule for a new trial. At the appeal, both parties can now be represented by an attorney of their choosing. If you are the Plaintiff and you lose your case on the day of the first trial, you cannot appeal. Unfortunately, you only get one attempt at winning.
